Nuisance and Swimming Pools: Tips to avoid neighbor disputes

However, your enjoyment must not compromise the well-being of your neighbors, who could suffer inconveniences because of your pool. Conflicts with neighbors can be distressing and cause disruptions in your daily life. It is therefore preferable to anticipate them in order to avoid them. By being aware of the potential nuisances caused by your pool, you can act in a way that minimizes them.

During the construction of the pool

Prolonged work can cause inconvenience for your neighbors. Between the noise of machines, the permanent presence of workers and the eventual impacts on their property, they could legitimately express their dissatisfaction regarding the construction.

Remember to warn them in advance, and when feasible, try to organize the building site during their absence. During the work, take care to limit inconveniences for them as much as possible and do not hesitate to inform the site manager in case of any issues.

Legal distance from neighbors

You cannot install your pool wherever you like, particularly on the part of your land adjacent to that of your neighbors. The Town Planning Code requires you to respect a minimum distance of 3 meters between your neighbor’s fence and the edge of your pool. Also make sure that your municipality’s PLU (local urban plan) does not set stricter rules, and that no RNU (national urban regulation) or POS (land use plan) imposes additional specificities.

Visual nuisances

Sometimes, a problem of privacy (overlooking) can create tension. By threatening the privacy of your neighbors, you risk causing dissatisfaction. Discuss with them the best solutions to adopt to preserve the visual comfort of everyone (hedges, screen fencing, etc.). Also ensure, during the design phase, that no construction (shelter, pool house) obstructs the sunlight on their land or their home.

Noise nuisances

Noise is also a source of complaints from your neighbors. Equipment such as the filtration system, heating, and the pump can be noisy, not to mention the splashing and shouting of children playing around the pool. Be sure to place noisy equipment at a reasonable distance from neighbors and control the shouting of swimmers. Also respect reasonable hours for your aquatic activities, because just like other noisy activities, they could generate complaints if there are significant nuisances.

Security

Your neighbors may also express concerns regarding safety related to the presence of a swimming pool, especially for their children. Inform them that it will be secured in accordance with the law via a barrier, a cover, or an alarm.

Be careful not to flood your neighbors’ land when emptying an inflatable pool, and always ask for their agreement before this type of operation.

To fully enjoy your pool, make sure not to disturb your neighbors. This is a rule to pass on to all users of your pool, whether they are friends, adults, or children. Communicate about your project as much as possible even before installing the pool, in order to avoid preventable nuisances.

To gain your neighbors’ sympathy, do not hesitate to invite them for a swim or to suggest they enjoy the pool in your absence, this will foster better relations and constructive exchanges!
