What steps to take to build and install a pool? Declaration, Authorization & Building Permit

Before diving into the details of pool construction and landscaping, it is essential to become familiar with the legal and administrative requirements surrounding this type of project. Indeed, depending on the size, location, and other criteria, certain administrative formalities may be necessary to obtain the desired authorizations.

Situations requiring a preliminary declaration of work: In-ground or Above-ground Pool

Before starting the installation or construction of your pool, it may be necessary to request authorization from the town hall, primarily based on the planned surface area of your basin.

  • In-ground pool between 10 and 100 m² : for an in-ground pool with a basin surface area between 10 and 100 m², a preliminary declaration of work to the town hall is required.
  • In-ground pool of more than 100 m² : in this case, a building permit will be required.
  • Above-ground pool : an above-ground pool must be subject to a declaration of work if its surface exceeds 20 m², if its height is greater than 1 meter, or if it is positioned less than 3 meters from property boundaries.
  • Protected or regulated zones : if your property is located in a classified zone or near a historical monument, a specific authorization might be necessary.
  • Local urban planning regulations : municipal provisions may also be required in certain cases.

It is imperative to submit a preliminary declaration based on the dimensions, location, or other characteristics of the pool. Information regarding the Local Urban Planning Scheme (PLU) in effect in your sector can be obtained from the town hall or the town planning department of your municipality. In the context of creating a pool, the PLU’s main role is to establish a regulatory distance between your pool and the neighboring property boundaries.

Submit a request for a pool work declaration

You will need to complete the Cerfa form n°13703*10 and provide the necessary supporting documents (plans, photos, etc.). Submit your file in two copies to the town hall of the locality where your pool will be built, or send it by registered letter with acknowledgment of receipt. Since January 1, 2022, it is possible to transmit your request electronically according to the instructions of your municipality.

Subsequently, the town hall will set a date from which you can start your work if no objection is raised. You will receive a response within 1 to 2 months.

If your preliminary declaration is accepted, it will be valid for 2 years. In case of rejection of your request, you can ask for a reassessment of the decision from the town hall within 2 months following the notification.
